The seventieth anniversary of the United Nations Refugee Convention represents an opportunity to reflect on the state of its implementation and the urgency of renewing both its spirit and substance.
Talking about the application of a regulation established 70 years ago means also understanding its applicability in order to assess whether there is, in fact, a need for its requalification in light of a radically changed present. From the situation that emerges from the research, it is clear how often one encounters a very evident phenomenon of non-application of the rules, which is frequently due to administrative non-applicability. Moreover, it appears that this issue is not only administrative; in several instances, the lack of not only administrative coverage but also of a “cultural” coverage, calibrated for the efficiency and effectiveness of the rules, is highlighted.
